Model releases are an ugly fact of life...you have to use them. On EVERY shoot!
Whether you are a pro or not!
You need a model
release - signed in advance - on every shoot you do! Whether you think you need one or not.
And, truthfully, in most cases, you DON'T legally need one...but people will sue you anyway - hoping for a quick payday from a naive photographer who will settle out of court, just to make it all "go away". If you DON'T settle, the lawyers fees could destroy your business - even if you win!
And not just for "MODELS", you need them for families, kids, pets... if it is
identifiable, you need a release before you can publish that photo.
That even includes putting them in your
personal portfolio! Or, uploading them to Facebook, My Space, YouTube and so on... Even if you aren't a "pro" shooter!
You never know when that PERFECT shot will come along and you will want it in your samples, or on your website.
Or perhaps years down the road you will find the ideal use for that one particular shot!
True, you could go back after the fact and get a release signed, but be prepared to pay your "model" some hefty fees! (If they will sign a release at all!) Once they know you like the photo and want to
use it in some way, the greed bug sets in.
On the other hand - amazingly - people are flattered when you ask for a release BEFORE you shoot.
They'll almost always agree to sign. Go figure...
If you ever hope to publish, sell or in any way advertise with your photos -
not having a release is playing with fire. The lawsuits can
DESTROY your business! Even if you were to win - the attorney's fees could bankrupt you.
Model Releases DO HAVE A FEW Problems...
First: You are constantly running out - and it's a real pain in the patootie to constantly have to be re-ordering them!
Or remembering to drive down to the local camera shop and buy a pad of them. Not
to mention that over time, it can get expensive.
With these releases, you simply store the form on your computer and print out as many as you
want - whenever you want them.
Second: The commercially available ones are written as a "boiler plate" contract and have no personalization.
With all the filling in of names, yours included, etc. they look scary.
Imagine how much more professional your photo business will look when you

Clearly the second option looks more professional. And that's NOT the only personalization you will have on your personalized model release forms! Plus, since it is pre-printed, it appears like you do this all the time and it's no big deal.
You wouldn't have a form with your business name on it if it were some rare
thing. Most people will figure...if everyone else is signing these things, I may as
well sign one too. But...

like maybe lawyers need to be involved.

one out in advance of each session with the model's name pre-printed too!
